On March 14, 2022, a meeting of the Interdepartmental Commission on state financial support of national films took place under the chairmanship of the Minister of Culture and Sports Dauren Abayev. The participants discussedchanges in the legislation on public procurement, which in turn made adjustments to the rules for financing film projects claiming to be recognized as national.

As a result of new insertions the requirements for the financial stability of potential suppliers increased (Articles 40, 44 of the “Rules of Public Procurement” in accordance with the Order of the Minister of Finance of the Republic of Kazakhstan dated 14.01.2022 No. 35).

The Interdepartmental Commission made the following decisions:

- To leave without consideration the conclusion of the Expert Council (Protocol No. 14 dated 09/16/2021, No. 1 dated 02/14/2022) due to the need to study in accordance with the requirements of budget legislation and public procurement;

- Recommend to the State Center for Support of National Cinema to organize a new pitching for the selection of film projects that claim to be recognized as national.

Thus, the results of the 2021 competitive selection are left without consideration and a new competitive selection is announced taking into account changes in legislation.

For reference: By Order of the Minister of Finance of the Republic of Kazakhstan dated January 14, 2022 No. 35, amendments and additions were made to the Rules for Public Procurement (hereinafter referred to as the Rules), in particular, on the application by Customers of the financial stability indicator to potential suppliers of goods, works and services.

Prior to the entry into force of these changes, the presentation of requirements in the form of financial stability was distributed exclusively for purchases carried out by means of a tender or auction, if the amount exceeds the established indicators.

However, according to paragraph 3 of paragraph 40 of the current Rules, qualification requirement in the form of financial stability of a potential supplier it is presented to potential suppliers “participating in public procurement of services, where the allocated amount of the relevant public procurement (lot) exceeds eight thousand times the size of the monthly calculation index established for the corresponding fiscal year by the law on the republican budget”.

Previously, the specified requirements for financial stability did not apply to purchases on the grounds of subparagraph 3) of paragraph 3 of Article 39 of the Law, what allowed the use of a method of purchasing from a single source by directly concluding a public procurement contract, which are carried out in cases of acquisition of goods and services that are objects of intellectual property from a person who has exclusive rights in respect of purchased goods, services, as well as work on the adjustment of pre-design or design estimates.
